Terms of Service

Gianquest is operated by Sellectro UG (haftungsbeschränkt), Karl Marx Straße 1 (Oderturm), 15230 Frankfurt (Oder), Germany, registered with the Amtsgericht Frankfurt (Oder) under HRB 21282.

Section 1 Scope

1.1 These Terms of Service apply to all orders placed through the online shop www.gianquest.com as well as by email at Sellectro UG (haftungsbeschränkt), referred to below as Gianquest. Any deviating terms proposed by the customer will not be recognized unless Gianquest has expressly agreed to them in writing.

1.2 These terms apply exclusively to consumers within the meaning of Section 13 of the German Civil Code, meaning natural persons who enter into a transaction for purposes that are not predominantly related to their commercial or independent professional activity. Consumers are also referred to below as customers.

Section 2 Offer and Conclusion of Contract

2.1 The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation for the customer to place an order.

2.2 By submitting an order through the relevant button, the customer makes a binding offer to purchase. This offer remains valid for four weeks. Gianquest reserves the right to decline orders without giving reasons. The order confirmation sent by email does not yet constitute acceptance of the purchase offer, but merely confirms that the order has been received. A contract is only concluded once Gianquest separately confirms acceptance of the offer by email or ships the goods.

2.3 Gianquest reserves the right to continuously adapt and, where necessary, limit individual features of its service offering.

Section 3 Prices and Payment

3.1 The prices listed in the online shop are final prices and include the applicable statutory value added tax as well as all other price components. Delivery costs are shown separately.

3.2 Gianquest offers various payment methods. Which payment options are available can be viewed before completing the order process. Gianquest reserves the right not to offer certain payment methods, or to offer them only for specific orders.

3.3 All prices are generally shown in Euro.

Section 4 Delivery

4.1 Gianquest currently ships only to Germany. Orders are dispatched from either Germany or France, depending on product availability and warehouse location.

4.2 Two delivery options are available at checkout:

Free shipping, with an estimated delivery time of 4 to 5 business days.

Insured express shipping for a fee of 4.95 EUR, with an estimated delivery time of 2 to 3 business days.

4.3 Delivery times are estimates and may vary depending on carrier performance and external circumstances beyond our control. Gianquest works with reliable shipping partners to ensure orders arrive safely and on time.

Section 5 Retention of Title

The delivered goods remain the property of Gianquest until full payment of the purchase price has been received.

Section 6 Right of Withdrawal

Withdrawal Notice

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period will expire fourteen days from the day on which you, or a third party other than the carrier and indicated by you, acquire physical possession of the goods

of your decision to withdraw from this contract by an unambiguous statement, for example a letter sent by post or an email. You may use a copy of the model withdrawal form below, although this is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (with the exception of any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and in any event no later than fourteen days from the day on which we are informed of your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment you used for the original transaction, unless expressly agreed otherwise; in any event you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back, or until you have supplied evidence of having sent back the goods, whichever is the earliest.

You must send back the goods or hand them over to us without undue delay and in any event no later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

You will bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Section 7 Warranty and Liability

7.1 The statutory warranty rights apply.

7.2 Claims for damages by the customer are excluded, unless otherwise specified below. This does not apply to damages arising from injury to life, body, or health, nor to damages resulting from a breach of essential contractual obligations, nor to other damages caused by intentional or grossly negligent conduct on the part of Gianquest, its legal representatives, or vicarious agents.

7.3 In the event of a breach of essential contractual obligations, Gianquest is only liable for the foreseeable damage typical for this type of contract, provided the breach was caused by simple negligence, unless the damage relates to injury to life, body, or health.

7.4 The above limitations of liability also apply in favor of the legal representatives and vicarious agents of Gianquest, insofar as claims are asserted directly against them.

Section 8 Data Protection

The collection, processing, and use of personal data is carried out exclusively in accordance with the applicable data protection regulations. Further information can be found in our Privacy Policy, which is available at any time on our website.

Section 9 Assignment and Transfer

Gianquest is entitled to transfer rights and obligations arising from the contractual relationship, in whole or in part, to third parties. In the event of such a transfer, the customer is entitled to terminate the contract as of the date of the transfer.

Gianquest is entitled to assign outstanding claims to third parties for collection purposes.

Section 10 Promotions, Discounts, and Offers

From time to time we may run promotions that reduce the price of certain products. If a promotion is activated by a discount code, the customer must enter the code at checkout. Each promotion, discount, and offer has its own terms, which will be communicated at the time it is introduced. Unique, personal discount codes are non transferable and may not be shared publicly. Promotions, discount codes, and offers cannot be combined with one another. Offers have no cash value and cannot be applied to previous purchases. Gianquest reserves the right to change or end promotions at any time without prior notice.

Section 11 Final Provisions

11.1 Contracts between Gianquest and consumers are governed by German law, excluding the United Nations Convention on Contracts for the International Sale of Goods. For contracts with consumers, this choice of law applies only to the extent that it does not deprive the consumer of the protection granted by mandatory provisions of the law of the country in which the consumer has their habitual residence.

11.2 Should individual provisions of these Terms of Service be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the applicable statutory regulation.
